1. Who We Are

TwoTraderAuctions is an online auction platform that connects buyers with repossessed and institutional vehicles, watercraft, and equipment. We are not the owner or seller of the items listed on the Site. We act as a marketplace and intermediary, sourcing inventory and listing it on behalf of banks, lenders, and institutional consignors. Every item listed on TwoTraderAuctions is personally verified by our team — including a clear title check — before it is made available for bidding.

2. Eligibility & Account Registration

To bid on TwoTraderAuctions, you must:

• Be at least 18 years of age;
• Be legally capable of entering into a binding contract;
• Provide accurate, current, and complete registration information;
• Complete our identity verification (KYC) process described in Section 3.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Identity Verification (KYC)

Before placing a bid, you will be asked to complete a Know Your Customer (KYC) verification, which may include submitting a government-issued photo ID and other supporting documentation. This step protects all bidders by keeping the auction process fair, secure, and free of fraudulent activity. Your KYC information is handled in accordance with our Privacy Policy.

4. How Bidding Works

We reserve the right to extend bidding on an active auction by a short period if a bid is placed in the final moments, to ensure all bidders have a fair opportunity to respond.

5. Bids Are Binding

If you win an auction and fail to complete the purchase, your account may be suspended and you may be held responsible for any costs incurred by TwoTraderAuctions as a result, including re-listing fees and any difference in sale price.

6. Vehicle & Equipment Condition

Every listing on TwoTraderAuctions is personally inspected and verified by our team before it goes live, including confirmation of a clear title. Listings include photos and a written description of known condition, mileage/hours (where applicable), and any flaws we are aware of at the time of listing.

While we make every effort to disclose known issues accurately, vehicles and equipment sold through our platform are previously owned, and buyers should expect normal wear consistent with the item's age, mileage, and use. We strongly encourage you to review all listing photos and descriptions carefully, and to ask questions through our Support Center before bidding.

7. 5-Day Inspection & Return Policy

We know that buying a vehicle sight-unseen takes trust — that's why every purchase made through TwoTraderAuctions includes a 5-day inspection period, starting from the date of delivery.

7.1 What's Covered

• The vehicle remains insured by TwoTraderAuctions for the full duration of the 5-day inspection period.
• You may return the vehicle for any reason during this window.

7.2 What's Not Covered

• Any damage, accident, or loss caused by the buyer during the inspection period is the buyer's responsibility and may be deducted from your refund or invoiced separately.
• Vehicles must be returned in substantially the same condition as delivered, normal test-driving wear excepted.
• Returns initiated after the 5-day window has closed will not be accepted.

7.3 How to Initiate a Return

Contact our Support Center within the 5-day window to begin the return process. Our team will guide you through vehicle pickup/drop-off logistics and refund timing.

8. Payment Terms

• Winning bidders will receive an invoice shortly after the auction closes.
• Payment must be completed within the timeframe specified on your invoice.
• Accepted payment methods will be listed at checkout and on your invoice.
• Failure to complete payment within the required timeframe may result in cancellation of the sale and suspension of your bidding privileges.

9. Title, Documentation & Delivery

All vehicles listed on TwoTraderAuctions are verified to have a clear title prior to listing. Upon completion of payment, we will coordinate title transfer and delivery logistics with you. Delivery timeframes vary by location and item; estimated timing will be communicated by our team after purchase.

10. Fees

TwoTraderAuctions does not charge buyer's premiums or hidden platform fees. The amount you bid is the amount you pay for the item itself. Any applicable taxes, title/registration fees, or delivery charges (where applicable) will be clearly disclosed before you complete your purchase.

11. Prohibited Conduct

When using the Site, you agree not to:

• Provide false or misleading information during registration or KYC verification;
• Place bids you do not intend to honor;
• Use automated systems, bots, or scripts to place bids or scrape Site content;
• Interfere with or disrupt the Site, servers, or networks supporting the Site;
• Attempt to circumvent our identity verification or fraud prevention measures;
• Use the Site for any unlawful purpose.

Violation of this section may result in immediate account suspension or termination, and may be reported to relevant authorities where appropriate.

12. Disputes Between Buyers & TwoTraderAuctions

If you have a concern about a transaction, please contact our Support Center first — most issues can be resolved quickly through direct communication. If a dispute cannot be resolved informally, both parties agree to attempt good-faith negotiation before pursuing formal legal action, except where applicable law provides otherwise.

13. Disclaimers

The Site and Services are provided "as is" and "as available." While we personally verify each listing and confirm clear title prior to sale, we make no warranty that the Site will be uninterrupted, error-free, or completely secure. Except as expressly stated in Section 7 (5-Day Inspection & Return Policy), all sales are made without warranty of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.

14. Limitation of Liability

To the fullest extent permitted by law, TwoTraderAuctions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or participation in an auction, except as expressly provided under Section 7. Our total liability for any claim arising from a transaction shall not exceed the amount you paid for the item giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless TwoTraderAuctions LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your breach of any representation made during registration or KYC verification.

16. Account Suspension & Termination

We reserve the right to suspend or terminate your account at our discretion, including for violation of these Terms, suspected fraudulent activity, failure to complete payment on a won auction, or any conduct we reasonably believe is harmful to other users or to TwoTraderAuctions.

17. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in Illinois, except where applicable consumer protection law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. The "Last Updated" date at the top of this page indicates when these Terms were last revised. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
